Enduring Power of Attorney (EPA) in Hong Kong

In Hong Kong, an Enduring Power of Attorney (EPA) must be signed before one registered medical practitioner and one solicitor. Role of the Doctor

  • Certifying mental capacity: The doctor must be satisfied that the donor understands the nature and effect of the Enduring Power of Attorney at the time of signing.

  • The attorney cannot act as a witness: The appointed attorney — or the attorney’s spouse or relative — cannot serve as a witness for the EPA.
